A man in an intoxicated state wanted to borrow alcoholic beverages, but he was refused. This led to a verbal argument, which soon escalated into a physical confrontation.
The defendant stated that during the confrontation, the victim insulted his mother and wife, and then grabbed him by the neck. The shop owner struck him several times in an attempt to free himself, resulting in the victim losing consciousness.
The victim was taken to the hospital but later died from his injuries. The court found the shop owner guilty of committing crimes as stipulated in the following articles of the Criminal Code: part 3 of article 104 (deliberately causing serious bodily harm, resulting in the victim's death) and part 1 of article 277 (hooliganism).
