Marriage contract: remote and mobile procedures are proposed
A new draft Regulation on the procedure for formalizing marriage contracts has been developed in Uzbekistan. This was reported by Zamin.uz.

This draft aims to introduce modern technologies to increase convenience for the population and to simplify the processes further. The draft Regulation proposes several forms of concluding a marriage contract.

The traditional method of concluding a contract at a notary office will be retained. Additionally, methods for formalizing contracts remotely via video communication or in a mobile manner, i.e., outside the notary office at the request of applicants, are proposed.

Processes carried out remotely are recorded in audio and video in the "Notarius" automated system. In the mobile procedure, a video recording is required to fully confirm the process.

Modern technologies are used in the identity verification process. The notary uses biometric data to identify and verify the parties' identities.

When signing the contract, at least two fingerprints must be scanned using special devices. Notarial actions are conducted in the state language.

However, at the citizens' request, the contract text can also be prepared in other languages. If the parties do not understand the contract language, an oral translation is provided by the notary or an interpreter at their suggestion.

Information about the interpreter is reflected in the document, and a warning about liability for incorrect translation is given. According to the Regulation, a marriage contract is concluded only between persons who have reached marriageable age.

If the marriage between the parties is not registered, the contract will not have legal force. Citizens can apply directly to the notary office or register electronically through the Unified Interactive State Services Portal and the E-notarius.uz system.

The application must be reviewed within one working day. The draft Regulation also includes conveniences such as procedures for amending and canceling the contract, grounds for refusal of notarial actions, automatic calculation of fees, and confirmation via SMS.

The implementation of this draft is aimed at improving the quality of legal services for citizens.
