A new article may be added to the Administrative Responsibility Code. On March 27, the Ministry of Internal Affairs submitted the relevant draft law for public discussion.
The draft proposes to introduce a new Article 126-1 regarding "tinting" into the code:
"Article 126-1. Use of vehicles in violation of the requirements specified in the relevant permit for changing (darkening) the color of windows.
Failure to comply with the rules established in the relevant permit for changing (darkening) the color of windows will result in a fine equal to one base calculation amount (BHM).
The current amount of one BHM is 375,000 soums.
Currently, in Uzbekistan, it is possible to change the color of the front side windows of a car by paying 8 times the BHM (3 million soums). If the permit is obtained online from the my.gov.uz portal, the payment amount will be discounted to 2.7 million soums.
According to the standards set in this permit, the front side windows can be darkened up to 30 percent.
Zoyir Yo‘ldoshev, the press secretary of the Traffic Safety Department, stated that in practice, there have been cases of darkening windows by 50 percent and even 100 percent after obtaining the permit.
In such cases, under the existing Article 126 of the Administrative Responsibility Code (use of vehicles with tinted or darkened windows without a permit), a fine of 25 times the BHM (currently 9 million 375 thousand soums) is imposed.
"If someone pays several million for a permit for 'tinting' but still has a tint that seems non-compliant, and then has to pay a fine of 25 times the BHM, we consider this unfair.
Therefore, we initiated a project to impose a fine of one BHM for those who do not comply with the standards set in the tinting permit.
If this Article 126-1 is adopted, the 'tinting' permit will not be revoked from offenders. Instead, the excess tint will be removed, and they will be allowed to apply a tint up to 30 percent. The existing Article 126 of the Administrative Responsibility Code – a fine of 25 times the BHM (9 million 375 thousand soums) for unauthorized 'tinting' will remain in effect. This is a different situation," said Zoyir Yo‘ldoshev in an interview with Kun.uz.
The draft law has been submitted for public discussion until April 11 of this year, and all citizens can follow this link to provide their opinions and suggestions.
Payments for tinting
In Uzbekistan, as of July 1, 2022, the procedure for obtaining a permit for changing (darkening) the color of the rear side windows of light vehicles has been abolished. This means that the rear side windows can be darkened without any payments.
At that time, the fee for obtaining a permit for changing (darkening) the color of the front side windows of light vehicles for individuals and legal entities was set at 8 times the BHM – currently amounting to 3 million soums. Obtaining a permit through the Single Interactive State Services Portal is 10 percent cheaper.
According to the government decision, the funds obtained from issuing this permit will be allocated as follows:
- 40 percent to the state budget;
- 40 percent to the fund for developing the material and technical base of the State Traffic Safety Service of the Ministry of Internal Affairs, as well as for incentivizing and rewarding its employees;
- 20 percent to the "Safe Road and Safe Pedestrian" fund of the Ministry of Internal Affairs.
