Senate approved the mechanism for compensating damages caused by state bodies
At the next plenary session of the Senate, the issue of compensating for damages caused by unlawful actions or omissions by state bodies or their officials was discussed and approved. Zamin.uz reported this.
With the implementation of this law, a single and clear legal mechanism will be established in our country for compensating material damages caused by state bodies or officials. Previously, the issue of compensation was regulated by more than ten different laws and sub-legislative acts.
However, such fragmentation caused many problems in practice. In particular, various difficulties arose in the processes because the procedure for making payments from the state budget was not clearly defined.
The new law is aimed specifically at eliminating these shortcomings. According to the law, a unified procedure will be introduced for compensating damages caused by state bodies and officials.
If the damage is fully compensated from the state budget, there will be an opportunity to recover the funds from the guilty person afterward. This process is of great importance for restoring state expenditures and ensuring accountability.
Under this procedure, the Cabinet of Ministers of the Republic of Karakalpakstan, regional and Tashkent city administrations, as well as the state body where the guilty person operates, will have the right to submit a claim. The main principles of the new law consist of human rights, legality, transparency, and openness.
Additionally, special regional funds will be established to ensure the compensation of property damages, and their sources will be clearly defined.
