
The interdistrict court in Fergana region reviewed a claim regarding the violation of copyright of the famous composer O‘ktam Hakimov's song “Ismigul.” This was reported by Zamin.uz.
The defendant in the case was the artist known by the pseudonym Nadyr, Nodirbek Igamberdiyev. In 2023, he rearranged the song “Ismigul” in the style of “Enigma” and distributed it on several international platforms.
This version entered the top ten on the iTunes chart and became widely popular on Instagram. However, after receiving complaints from the author about the infringement, the song was removed from all platforms.
Based on the claim brought by the Public Association of Copyright and Related Rights Holders of Uzbekistan, the court decided to recover a total of 46 million 200 thousand soums from Nodirbek Igamberdiyev. Of this amount, 41.2 million soums were for damages caused by the copyright infringement and 5 million soums were set as moral damages.
According to the court ruling, Nodirbek Igamberdiyev is required to completely stop using the work “Ismigul.” In particular, broadcasting the song, distributing it on social networks, and showing it through television and radio channels are strictly prohibited.
In accordance with Uzbek legislation, in cases of copyright infringement, authors have the right to demand compensation for damages or compensation ranging from 20 to 1000 times the base calculation amount.
